Use 49 (O) to boycott elections..Do you know it?

A very few people in our country knows about a provision called 49-O in the constitution of India. This is under the Conduct of Elections Rules, 1969 Act, in which a voter can go to the polling booth, confirm his identity to the polling officer and also get his fingers marked with the black ink. After that he or she can say his desire to the presiding officer in the booth that he or she does not want to give vote to any candidates. This feature is available in our constitution from a long time but the general public does not have the knowledge because these things have never been advertised.

As a citizen of a democratic country, we the people of India have the right to choose the right candidate. In case, we found none of the candidate deserves to become the future politician, we better do not give vote to anyone.

We can do this in the following steps.



* After our electoral roll number has been registered in the list of registered voters in Form-17A.
* Put signature or thumb expression as per the sub rule (1) of rule 49L.
* Now, you decided that you do not want to give vote to any candidate and inform the presiding officer.
* Presiding officer will then make a remark and this will effect in the entry Form 17A.
* He will then ask you to put signature or thumb expression against that remark.

How do we get benefits out of it?

It is beneficial for the public who do not want any candidates from that constituency to win. It happens like this, say for example a candidate wins by ‘xyz’ votes in a particular constituency but in case that particular constituency has received 49-O votes more than ‘xyz’, the polling will be cancelled and there can be a chance of re polling.

When there is a re polling announced for the particular constituency, there is a 99% chance that the party will remove the particular candidates and choose more appropriate candidate for the election from that particular constituency.

The election commissioner has not revealed this wonderful feature to the public. This is not advertised either. So by the means of my way of communication through this website, I want every citizen of India to know about this feature. This is our right. And I feel this is my duty to spread this news to every Indians. Also my request to every Indians who read this article please spread it so that more and more public should aware of this wonderful right. At this time when the election is near, we must spread this news to all countrymen.

We the citizen of India has to unite and understand the fact that most of our leaders are chosen by us who actually do not deserve the post. We should not close our eyes, and think, what can be done by me as an individual. If everybody thinks like this, then no body will come forward to take any bold steps. We should not give our country and its constitution in the hands of undeserved leaders who only can see their own benefits rather than the benefit of a country as a whole.

Worthless to mention the numbers of politicians, but maximum number of politicians are full equipped with the security personals for them day and night. They invest so much on them and on the vehicles they travel. We are the tax payers; we want to see the work done for the huge amount of money we give as tax to the governments. We also expect that the public should also be protected from the enemy, terrorist and all.

We have democracy, so we expect that the leaders we choose must work for the welfare of the mass and not for the individual. Being a citizen of India it’s a request to every Indian, just spread and pass the message of 49-O to every one you know. It’s an awakening.
